The President issued an executive order amending previous delegations of authority under the Defense Production Act. The document, Executive Order 14427, was signed on Sept. 8, 2026, and published in the Federal Register on Sept. 11, 2026.
The order amends Executive Order 13603, which delegates certain presidential authorities to specified executive department and agency heads.
The document strikes text delegating authority to the Secretary of Energy with respect to all forms of energy. Instead, it delegates authority to both the Secretary of the Interior and the Secretary of Energy with respect to all forms of energy under their purview. The document says each secretary may exercise the delegated authority independently of the other.
If a dispute over energy arises between the two secretaries, the order directs that the matter be referred to the National Energy Dominance Council in the first instance. If the dispute implicates national defense infrastructure or military operations, the order states it must be referred to both the National Energy Dominance Council and the National Security Council. In such cases, both councils must coordinate with the Department of War to resolve the matter.
The order also updates authorities under section 101 of the Defense Production Act, delegating them to the Secretary of the Interior, the Secretary of Commerce, and the Secretary of Energy. The order states that the Department of the Interior will bear the costs for publishing the document.
